Council endorsed final readings to amended Bylaw 559, the Utilities Bylaw.

Bylaw 562 – LUB Amendment #12

Council endorsed first reading to Bylaw 562 – Amendment #12 to Land Use Bylaw 461. The amendment updates and clarifies Section 40, for Fences. A Public Hearing will be held on September 19, 2019 at 6:00 pm in the Town Administration Office Council Chambers at 4818 – 47 Street, Sedgewick. Draft copy of Bylaw 562 may be viewed on the Town of Sedgewick website (www.Sedgewick.ca)

2019 Capital Budget Amendment

Council approved an amendment to the 2019 Capital Budget to fund the increased Main Street Revitalization Project totalling $100,000 from the General Capital Reserve. Council also approved the transfer of funds from the Fire Truck Reserve to the General Capital Reserve.

FIP – Next Generation Broadband Project

Council approved commitment to Phase I and II of the Regional Broadband Project.

Main Street Pole-Mount Christmas Lighting

Council approved the purchase of 12 pole-mount Christmas Lights for $7,898 with the source of funding to be the General Operating Reserve.

Intermunicipal Collaboration Framework (ICF)

Council appointed Mayor Robinson and Councillors Levy and Imlah as representatives for the development of the ICF. (The ICF is a new legislated requirement.)

Flagstaff Scottish Club

Council waived the fees for the Flagstaff Scottish Club to use the portable stage on August 24, 2019 in exchange for a full-color ad in their program for the 2nd Annual Gathering of the Clan Highland Festival.

Designated Officers Bylaw

As per the 2019 Municipal Accountability Program Review Report, Council endorsed Designated Officers Bylaw 558 that establishes the positions of Assessor, Assessment Review Board clerk, Subdivision and Development Board clerk and any other required designated officers.

Utilities Bylaw

Council gave first reading to Utilities Bylaw 559 which addresses maintenance and repair responsibilities for water and sanitary sewer lateral lines.

Intermunicipal Assessment Review Board Bylaw

As per recommendations from the 2019 Municipal Accountability Program Review Report, Council endorsed Intermunicipal Assessment Review Board Bylaw 560 that replaces the former Intermunicipal ARB Bylaw 494.

Flagstaff Regional Subdivision & Development Appeal Board Bylaw

As per recommendations from the 2019 Municipal Accountability Program Review Report, Council endorsed Flagstaff Regional Subdivision & Development Appeal Board Bylaw 561 that replaces former Flagstaff SDAB Bylaw 489.

2019 Tax Recovery Auction

Council approved the reserve bids and conditions of sale for the 2019 Tax Recovery Auction properties.

Regional Broadband Project

Council withdrew from participating in the Regional Broadband Project due to the departure of other municipalities from the project.

FIP Managing Partner

Council decided to notify the Flagstaff Intermunicipal Partnership that they are not prepared to commit to a further 5 years under the current format.

Development Permit 2019-09 Variance

Council approved Development Permit 2019-09 for Plan 3825P, Block 7, Lot 1 and part of Lot 2, allowing a 5’ high fence to be built with a variance of being installed 11’ 6” from the north curb. Further, Council directed Administration to develop an amending bylaw to clarify section 40.1 of Land Use Bylaw 461 based on Council input.

Sidewalk Assessment

Council reviewed a sidewalk assessment and committed $10,000 to making the necessary repairs.

Splash Park

Council allocated $3500 towards a high-lift sewage pump for the spray park.

Summer Meeting Schedule

Council rescheduled their July regular meeting to July 30^th at 6pm and cancelled their August regular meeting.

Spruce Drive Sewer Extension

Council decided not to further extend the sewer on Spruce Drive at this time due to budgetary constraints.

Recreation Funding Committee – Phase I Allocations

Council approved the Phase I Recreation grants as per the recommendations of the Recreation Funding Committee:

Lifesaving Society Canada – National Drowning Prevention Week

Council declared July 21-27 as National Drowning week with the following motion:

Whereas the mission of the Lifesaving Society Canada is to prevent drowning throughout this great country, and even one drowning in Alberta is one too many; and

Whereas most drowning are preventable in a Water Smart community, and only through Water Smart education and a healthy respect for the potential danger that any body of water may present can we truly enjoy the beauty and recreation opportunities offered by these bodies of water; and

Whereas the Lifesaving Society urges Canadians and residents of Sedgewick, Alberta to supervise children who are in and around the water, to refrain from drinking alcoholic beverages while participating in aquatic activities, and to wear a Personal Flotation Device or lifejacket at all times when boating; and

Whereas the Lifesaving Society Canada has declared July 21 – 27, 2019 National Drowning Prevention Week to focus on the drowning problem and the hundreds of lives that could be saved this year.

Therefore, be it resolved that I, Perry Robinson, Mayor, do hereby proclaim July 21 – 27, 2019 National Drowning Prevention Week in Sedgewick, Alberta and do commend its thoughtful recognition to all citizens of our community.

Council approved the following motions during the May 22, 2019 Council Meeting:

2019 Operating Budget

Council approved the 2019 Operating Budget set out with a request for $830,000 in Taxes which is a 1.76% increase overall, including the Alberta School Foundation Fund and the Regional Housing Group requisitions.

2019 Capital Budget

Council approved the 2019 Capital Budget with capital spending totalling $3,879,000.

June Regular Meeting Re-scheduled

Council approved the rescheduling of the June Regular meeting to the fourth Thursday in June, on June 27^th at 6:00 pm at the Town of Sedgewick Administration Office.

Council has approved a motion to reschedule the Regular Council meeting from the third Thursday of the month to Thursday, June 27th at 6 PM

Council has approved a motion to reschedule the Regular Council meeting from the third Tuesday of the month to Wednesday, May 22nd at 6 PM.

A Special Council Meeting will be held in the Town Office (4818 – 47th Street) Council Chambers to address the following business items:

Procedural Bylaw 555

The Municipal Accountability Program Review identified gaps in Bylaw 535, which is the Town of Sedgewick Procedural Bylaw. Council passed Procedural Bylaw 555 which addressed the gaps:

• Removed provisions that allowed for councillors to cancel meetings in writing
• Removed the allowance for all votes that were not unanimous to be recorded votes
• Corrected the term “in Camera” to a “closed session.”

Animal Control Bylaw 556

Dog Control Bylaw 464 was approved in August 2009. Re-named Animal Control Bylaw 556 was passed with updates that included:

• New definitions for Nuisance, Service and Restricted Dogs
• New Licensing categories for Nuisance, Service & Restricted Dogs
• New requirements of an owner whose animal/dog has been classified as a nuisance or restricted animal
• New restrictions the CAO may impose for Nuisance and Restricted Dog

Recreation & Culture Boards Sub-Committee Appointments

Council appointed Councillors Sparrow and Schmutz to the new Recreation and Culture Boards Sub-Committee established this spring, comprised of two designates from the Recreation, Golf Club, Community Hall and the Sedgewick Lake Park Boards, charged with three main goals:

• To develop a cohesive staffing structure through shared employment between the recreation and culture boards.
• To explore other areas of partnership that may be beneficial to the recreation and culture boards.
• To forward recommendations to the respective recreation and culture boards for approval.

Council addressed the following items at the Regular Council Meeting:

Municipal Accountability Program Review 2019

Municipal Affairs conducted a review of the Town of Sedgewick under the Municipal Accountability Program (MAP); the review included a CAO interview, review of Town documents and attendance by two Municipal Affairs representatives to the January 24, 2019 Council meeting. Council reviewed the MAP Report and directed Administration to submit a response plan to Municipal Affairs prior to the eight-week deadline.

Naming of Municipal Office

The recent MAP Review identified that a resolution of Council, naming 4818-47 Street as the Town Office was not made available. Council endorsed a motion to name 4818 – 47 Street in Sedgewick as the place of the municipal office.

Tax Recovery

Council directed Administration to inform Ackroyd Barristers & Solicitors by letter that if the tax arrears in respect of the parcel of land described as Plan 3825P, Block 3, Lots 15-18 are not paid before March 31, 2019 the Town of Sedgewick will offer the parcel for sale at a public auction that will be held in October 2019.

Municipal Emergency Management Plan

Pursuant to Emergency Management Bylaw 543, Council approved the updated Emergency Management Plan as presented.

2018 Financial Audit

Brian King Professional Corporation presented the Town of Sedgewick 2018 Financial Audit.

Dr. Meer Retirement Celebration

Council approved support for the retirement celebration for Dr. Meer by providing $200 towards venue rental fees, $500 for catering costs, up to $250 for a gift to be presented to Dr. Meer and advertising support at no cost.

Borrowing Bylaw 552

Council endorsed final reading to Borrowing Bylaw 552 that authorizes the Town of incur indebtedness by the issuance of debentures in the amount of $1.5 M for the purpose of revitalizing Main Street (4800 Block of 47^th Street) which is to include sanitary sewer mains, pavement, sidewalks, light fixtures and other landscaping items.

Council endorsed Sedgewick Public Library Bylaw 553.

Records Retention Bylaw

Council endorsed Records Retention Bylaw 554.

Flagstaff Intermunicipal Partnership (FIP) 2019 Budget

Council approved the 2019 FIP budget which results in a $5,653.93 requisition for the Town of Sedgewick.

Public Works – Joint Employment Opportunity

Council directed Administration to move forward in a partnership with the Town of Hardisty to jointly hire a third Public Works employee with the Town of Sedgewick being the lead employer and a 2019 budget of $30,000.

Lot Prices on New 54^th Avenue Residential Subdivision

Council endorsed a motion that the 54^th Avenue Phase I residential subdivision lots be priced at $5/square foot and that as an incentive Council agrees to cancel all property taxes owed to the municipality in 2019, 2020 and 2021 for individuals who purchase a lot before December 31^st, 2019.

March Council Meeting Postponement

Council rescheduled the March 21^st Regular Council meeting from a 6:00 pm start to 7:00 pm.

PUBLIC NOTICE TO ELECTORS OF THE TOWN OF SEDGEWICK, PROVINCE OF ALBERTA

TAKE NOTICE that the Council of the Town of Sedgewick, in the Province of Alberta, has given First Reading to Borrowing Bylaw 552/19 which will, upon final passage and approval, authorize the proper officers of the said Town of Sedgewick to borrow monies from the Alberta Capital Finance Authority by way of debenture issue, to pay for the cost of construction of the revitalization of  Main Street which is to include replacing sanitary sewer mains, pavement, sidewalks, light fixtures and other landscaping items located on the 4800 block of 47^th Street within the Town of Sedgewick;

The total cost of the aforesaid project amounts to $1,700,000.00. After deducting from this cost the amount of $200,000.00 to be received by way of Provincial Grants, the net amount to be borrowed on the credit and security of the municipality at large by the issue of debentures is $1,500,000.00. The debenture is repayable to the Alberta Capital Finance Authority in thirty (30) equal consecutive semi-annual instalments of combined principal and interest, with the semi-annual interest not to exceed eight (8) percent.

NOW THEREFORE NOTICE is hereby given by the Council of the Town of Sedgewick that, unless a petition of the electors for a vote on Bylaw 552/19 is demanded, as provided for by the terms of Section 231 of the Municipal Government Act the said Council may pass the said Borrowing Bylaw.

All persons interested are hereby notified and they are required to govern themselves accordingly.

INFORMATION FOR ELECTORS

Pursuant to Section 1(i) of the Municipal Government Act an “elector” means:

• A person who is eligible to vote in the election for a councillor under the Local Authorities Election Act.

Pursuant to section 47 (1) of the Local Authorities Election Act a person is eligible to vote in an election if he/she:

1. a) Is at least 18 years old,
2. b) Is a Canadian citizen, and
3. c) Has resided in Alberta for the 6 consecutive months immediately preceding election day and is resident in the area on election day.

Unless otherwise provided in the Municipal Government Act, or any other enactment, only electors of a municipality are eligible to be petitioners.

A petition must be signed by the required number of petitioners.  In the case of the Town of Sedgewick, the petition must be signed,

• by electors of the municipality equal in number to at least 10% of the population.

The petition for a vote must be received by the Chief Administrative Officer within 15 days of the last publication of this notice and shall contain on each page “an accurate and identical statement of the purpose of the petition”.

(Further requirements of the petition are provided in section 224 of the Municipal Government Act.)
